SMT JUSTICE T.RAJANI CRIMINAL PETITON No.2735 OF 2018 ORDER:

This petition is filed seeking for grant of anticipatory bail to the petitioner, who is A9, in Crime No.29 of 2017 on the file of Koyyuru Police Station, Visakhapatnam District. The offences alleged are under Section 25 and 20(b)(ii) r/w 8(c) of NDPS Act. 2.

Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.

Though the counsel for the petitioner, vehemently submits that this petitioner is not concerned with this crime, the confession of A8, who was engaged by this petitioner, shows that this petitioner is of the person who requested A8 to transport the Ganja, by promising to pay charges to him.

Hence, in the light of the above facts, this court opines that this is a not a fit case for granting anticipatory bail. 5.

Accordingly, the Criminal Petition is dismissed. However, the petitioner can file a petition seeking for regular bail by surrendering himself before the court below having the jurisdiction. The court below shall dispose of the bail application on merits, if any filed, expeditiously, preferably on the same day, subject to the pressure of other work.

As a sequel, miscellaneous petitions pending consideration, if any, in this case shall stand closed.
