THE HON'BLE Dr JUSTICE SHAMEEM AKTHER Criminal Revision Case No.1443 of 2006 ORDER:

This Criminal Revision Case, under Sections 397 & 401 of the Code of Criminal Procedure, 1973, is filed by the petitioner, challenging the judgment, dated 28.02.2006, passed in C.C.No.231 of 2004 by the I Additional Munisif Magistrate, Tenali.

The order, dated 04.12.2017, of this Court read as under: "At request of learned counsel for the revision petitioner, post on 11.12.2017, as he submits that the revision petitioner-P.W.1 is no more."

Today, there is no representation for the petitioner. However, without waiting for the counsel for the petitioner to advance arguments, this Court can verify the material on record and pass appropriate orders. Hence, I would like to verify the material on record and decide the Criminal Revision Case in accordance with law. 4.

Heard the learned Assistant Public Prosecutor representing the 3rd respondent-State and perused the record.

By way of the impugned judgment, the Court below acquitted the respondents 1 and 2 herein/A.1 and A.2 for the offence punishable under Section 420, under Section 248(1) of Cr.P.C. Aggrieved by the same, this Criminal Revision Case is filed.

As seen from the material placed on record, there is no evidence to believe that the respondents 1 and 2 herein/A.1 & A.2 have committed the offence punishable under Section 420 of I.P.C. The findings of the Court below are based on evidence. There is no miscarriage of justice to

take a different view. The Criminal Revision Case is devoid of merit and is liable to be dismissed.

In the result, this Criminal Revision Case is dismissed. Miscellaneous petitions, if any, pending in this Criminal Revision Case, shall stand dismissed.
