This petition is filed, under Sections 437 and 439 of the Criminal Procedure Code, 1973, seeking for grant oF bail to the petitioner-accused No. 1 in Crime No. 95 of 2Ot7 of Butchiyyapeta Police Station, Visakhapatnam District, registered for the oFFence punishable under Section B (c) read with Section 20 (b) (ii) (C) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Heard learned counsel for the petitioner and learned Public Prosecutor (A.P.).

Learned counsel for the petitioner submits that accused No.2 in this case was already granted bail by the learned Metropolitan Sessions Judge, Visakhapatnam, by virtue of order dated 27-09-2017 in Criminal Miscellaneous Petition No. 2548 of 2Ol7 and that the petitioner also stands on the same footing as that of accused No. 2. Learned Public Prosecutor does not refute the sa id submission.

Hence, considering the above, this Court is inclined to grant bail to the petitioner. The petitioner is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- (Rupees fifty thousand only) with two sureties for a like sum each to the satisfaction of the learned Additional ludicial I Class Magistrate, Chodavaram. The petitioner is directed to appear before the Station House Officer, Butchiyyapeta Police Station, Visakhapatnam
District, on every Saturday between 10 a.m. and 2 p.m. till filing charge sheet.
