Heard learned counsel for the petitioners and learned Public Prosecutor representing the 1st respondent-State and before ordering notice to the 2nd respondent.

The petitioners/accused Nos.1 & 2 of S.C.No.109 of 2016 on the file of Special Judge for trail of Offences under SC & ST (POA) Act, Ananthapuram. The said Sessions Case is outcome of crime No.102 of 2016 of IV Town Police Station, Anantapuramu, which is registered for the offences punishable under Section 506 r/w 34 IPC and Section 3(1)(r)(s) of SC & ST (POA) amended Act, 2015. It is on committal, the case is taken to the Court of Sessions for the learned Special Judge.

The contention in seeking to transfer is that there is life threat to the petitioners and they are unable to attend the Court and it is to be transferred to Kurnool.

In fact that cannot be considered as a ground for no basis to show there is any threat to the life even.

Having regard to the above, the Transfer Criminal Petition is dismissed for no grounds to transfer.
