SMT JUSTICE T.RAJANI CRIMINAL PETITON No.2903 OF 2018 ORDER:

This petition is filed seeking for modification of the condition, which was imposed, while granting bail to the petitioner, in Crl.M.P.No.1157 of 2017 by the Metropolitan Sessions Judge - cum - Special Judge to try the offences under NDPS Act, Visakhapatnam. The condition being that the petitioner has to execute a personal bond for Rs.50,000/- with two sureties for a like sum each to the satisfaction of the Additional Judicial First Class Magistrate, Narsipatnam.

The counsel for the petitioner submits that the petitioner is not in a position to furnish sureties to that extent, hence, he could not avail the benefit of the bail, which was granted on 13.04.2017. 3.

Hence, considering the above, the said condition is modified and the petitioner is directed to execute a personal bond for Rs.30,000/- with two sureties for a like sum each, within three weeks from today. Remaining order shall intact. 4.

Accordingly, the Criminal Petition is allowed. As a sequel, miscellaneous petitions pending consideration, if any, in this case shall stand closed.
