THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO CIVIL REVISION PETITION No.1587 of 2015 ORDER:

There is no further necessity to go and dwell deep into the matter in view of an unfortunate subsequent development that has taken place. The 1st respondent herein was the plaintiff in the suit filed for partition. The sole defendant in the suit was none other than the father of the petitioners in this revision. It appears Sri T.Srinivasulu, the sole defendant in the suit and the father of the petitioners has since died, it is obligatory on the part of the plaintiff as also the legal representatives of the deceased - defendant to be brought on record or to come on record on their own. In that view of the matter, I.A.No.649 of 2014 filed by the petitioners herein seeking impleadment as defendant Nos.2 and 3 to suit O.S.No.156 of 2013 deserves to be ordered.

Accordingly, the Civil Revision Petition stands allowed after hearing Sri C.Raghu, learned counsel for the 1st respondent/plaintiff. The I.A.No.649 of 2014 in O.S.No.156 of 2013 on the file of V Additional District and Sessions Judge, Ranga Reddy District at L.B.Nagar, is allowed. No costs. The miscellaneous applications, if any shall also stand dismissed.
