It is the case of the petitioner that he is the absolute owner and possessor of land admeasuring Ac.15.700 cents in Survey No.923 situted at Itugullapadu, Sri Avanidutha Kasinaina Mandal, Y.S.R.Kadapa District. When the petitioner intended to dispose of the said property approached the 5th respondent for executing registered sale deed, the 5th respondent refused to register the sale deed. Aggrieved by the same, the present writ petition is filed. Heard learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue.
Learned counsel for the petitioner says the subject land is shown as dot in R.S.R. list. As such, dot lands are not government lands. In view of the same, the respondents cannot refuse to register the sale deed. It is to be seen that recently Full Bench of this Court in Vinjamuri Rajagopala Chary v. State of Andhra Pradesh[1] dealt with the matter. In view of the same, the 5th respondent is directed to follow the principles laid down by Full Bench and take action accordingly.
With the above direction, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 21-06-2016 nvl
