ORAL ORDER:

Petitioners claim that they come from down trodden communities and have no fixed source of income and eking livelihood by doing daily wage works. Having found empty land in Survey No. 472 to an extent of Ac.4.52 cents as belonging to Government, more than 200 families have occupied the same and have been living therein for long time. Petitioners contend that several representations are made on their behalf by Madiga Reservation Porata Samithi but same were not responded and on the contrary respondents are trying to dispossess them. In the circumstances, petitioners instituted this writ petition praying to declare the action of the respondents in interfering/evicting them from their respective small huts situated in Survey No.472 as illegal. 2.

Except some photographs filed showing existence of huts, no other material is filed to show that for a long time they are living there and if they are dispossessed, it would cause great hardship and suffering. 3.

Representations made on behalf of petitioners are also cryptic, therefore, at this stage, no positive direction can be granted as sought for by the petitioners.

Having regard to the averments made in support of the writ petition, liberty is granted to the petitioners to make a detailed representation to the District Collector, Anantapuram ventilating their grievances and for allotment of house sites to them, if they are otherwise entitled for such assignment. It is needless to observe that as and when such representation is made, District Collector shall examine the claim of the petitioners vis-a-vis policy of the Government on assignment of house site pattas to the needy people coming from socially and economically backward classes. A decision to the same extent shall be communicated to the petitioners within six weeks from the date of submission of such representation.

Accordingly, the writ petition is disposed of. No costs. Having regard to the same, miscellaneous petitions, if any pending, are closed. ______________ P NAVEEN RAO,J DATE:11.9.2017 TVK
