HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Contempt Case No. 1646 of 2014 Order:

This Contempt Case is filed alleging non-implementation of the orders of this Court passed in WP No.21603 of 2013, dated 19.03.2014.

2. The Writ Petition was filed challenging the action of the respondent in not paying the retiral benefits and also difference of salary from the date of suspension till the date of retirement with interest at 12% p.a. This Court disposed of the Writ Petition with a direction to the respondent-University to consider the representation of the petitioner dated 09.07.2013 in the light of the decision cited before this Court. It appears that subsequent to disposal of the Writ Petition the terminal benefits were released to the petitioner with delay. Now, the learned counsel for the petitioner submits that the order of this Court was not fully complied with as no interest was paid for delayed payment. That issue cannot be decided in the Contempt Case and it is always open to the petitioner to agitate the matter with regard to payment of interest consequent to delay in payment of terminal benefits by treating it as fresh cause of action.

3. The Contempt Case is, accordingly, dismissed. There shall be no order as to costs.

4. As a sequel thereto, the miscellaneous applications, if any, pending in this Contempt Case shall stand closed. ________________________ A.
