THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.8088 OF 2015 ORDER:
This petition is filed for a writ of Mandamus declaring the action of the 2nd respondent municipality threatening to demolish the eight shops of petitioners at D.Nos.8-1155 and 8-1156 in the main road of Hindupur Road, Kalyanadurg Town, Anantapur District each shop admeasuring 82 X 26 feet without following due process of law as illegal and arbitrary and for a consequential direction to the 2nd respondent municipality not to demolish the eight shops of petitioners. Heard Sri N.Aswartha Narayana, learned counsel for the petitioners and learned G.P. for Municipal Administration, for first respondent and Sri Md.Saleem, learned Standing Counsel for the 2nd respondent. At the time of hearing, it is stated by the learned counsel for the petitioners that in similar circumstances, this Court disposed of Writ Petition No.5581 of 2015 and the same is not disputed by Sri Md.Saleem, learned standing counsel for the 2nd respondent.
Hence, this writ petition is also disposed of in terms of the orders of this Court dated 06.03.2015 in W.P.No.5581 of 2015, directing the respondents not to demolish the shops of the petitioners without following due procedure prescribed under law. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
