Heard learned counsel appearing for the petitioner, learned Government Pleader for Civil Supplies appearing for respondents 1 to 3 and learned Government Pleader for Home appearing for respondent No.4.

This Writ Petition is filed seeking to declare the action of the 2nd respondent in not releasing seized stock of 124 quintals of rice worth Rs.3,00,000/- in favour of the petitioner, as arbitrary and illegal. The petitioner is the owner of rice mill.

quintals of rice was seized from the rice mill of the petitioner on 9.1.2015 on the ground that the said rice was purchased from the PDS card holders. According to the petitioner, the said allegation is absolutely false. Learned counsel appearing for the petitioner submits that so far no proceedings have been initiated against the petitioner and the seized rice was kept in the premises of the petitioner under the custody of the revenue department. He further submits that the petitioner made an application to the second respondent-Joint Collector on 20.01.2015 for release of the seized stock, but so far no orders have been

passed.

Under these circumstances, the second respondent-Joint Collector is directed to consider the application made by the petitioner for release of the seized stock and pass appropriate orders thereon, in accordance with law, within a period of two weeks from the date of receipt of a copy of this order.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
