HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.5584 OF 2017 ORDER:

The case of the petitioner is that he was issued notice dated 20.01.2017 by the 3rd respondent under Rule 3 of the Andhra Pradesh Assigned Lands (Prohibition of Transfers) Rules, 2007 (for short 'the Act') stating that the petitioner has violated sub-section 2 of Section 3 of the Act, in respect of the land to an extent of Ac.1.00 in Survey No.459/A1, A4 and Ac.1.00 in Survey No.459/A1, A8 of Mydavolu Village, Edlapadu Mandal, Guntur District. In pursuance of the same, the petitioner submitted explanation dated 02.02.2017 to the 3rd respondent. But, without passing any orders on the same, the respondents are trying to evict the petitioner. Aggrieved by the same, present writ petition is filed. Heard both sides.

In view of the aforesaid facts and circumstances, the 3rd respondent is directed to pass final orders, within four weeks from the date of receipt of a copy of this order, in accordance with law, after issuing notice and affording opportunity of hearing to the petitioner. Till passing of final orders, status quo obtaining as on today shall be maintained.

With the above direction, the writ petition is disposed of. No order as to costs.
