THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 7314 of 2018 O R D E R :
This Writ Petition is filed to declare the action of the 2nd respondent - Assistant Engineer (Operations), Telangana State Southern Power Distribution Company Limited in not issuing new power-supply connection to shop Nos. 11 and 12 bearing H.No. 1-97/11 and 12 situated opposite to MS Convention Centre, Satamrai Village, Shamshabad Mandal, Ranga Reddy District, though the petitioner submitted an Application along with requisite fee vide banker's cheque dated 27.02.2018 and indemnity bond, as illegal and arbitrary.
The main grievance of the petitioner is that in spite of the fact that he is willing to comply with all the terms and conditions for getting electricity connection, his Application dated 27.02.2018 has not been processed so far.
Heard learned counsel for the petitioner as well as Sri R. Vinod Reddy, learned Standing Counsel for the respondents. Section 43 of the Electricity Act, 2003 casts a duty on the respondents to provide power connection, on an Application made either by the owner or the occupier of the premises within one month from the date of receipt of such Application. The respondents, therefore, shall process the Application dated 27.02.2018 of the petitioner and take appropriate steps to supply electricity, as per the general terms and conditions of supply. The Writ Petition is accordingly, disposed of. No costs.
Consequently, the miscellaneous Applications, if any shall stand closed.
