HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.7443 OF 2018 ORDER:

The grievance of the petitioner, in this Writ Petition, is that the proceedings, under Section 6A of the Essential Commodities Act, 1955 (for short 'the Act'), have been initiated and, pending the same, the respondents are proposing to dispose of the seized stocks.

Learned counsel for the petitioner contends that, pending disposal of 6A enquiry, the seized stocks may not be disposed of; and a time limit be fixed for completion of proceedings under Section 6A of the Act. He also contends that the seized stocks are not perishable in nature, and the petitioner is ready to furnish bank guarantee for the value of the stocks seized. 3.

Learned Government Pleader for Civil Supplies, on instructions, submits that, stocks seized from the petitioner are not perishable, and respondents will complete the enquiry under Section 6A of the Act within two months.

Having regard to the submissions of the learned counsel, the Writ Petition is disposed of directing the respondents to complete 6A proceedings initiated against the petitioner within a period of two months from the date of receipt of a copy of this order; pending enquiry, stocks seized from the petitioner may not be sold; and, if the petitioner furnishes bank guarantee for the value of stock seized, the respondents may consider for release of

the stocks to the petitioner. Miscellaneous Petitions pending, if any, shall stand closed. No costs.
