HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.11401 of 2017 ORDER:

The petitioner is aggrieved by inaction on the part of the respondents in completing the enquiry initiated against her under Section 6-A of the Essential Commodities Act, 1955 (for brevity "the Act").

The petitioner herein is a Fair Price Shop Dealer in respect of Shop No.39 of Kogantivaripalem Village, Atchampet Mandal, Guntur District. Basing on a report submitted by the 3rd respondent - Tahsildar, Atchampet Mandal, a case under Section 6-A of the Act was registered against the petitioner and the 2nd respondent - Revenue Divisional Officer, Guntur, issued a show cause notice dated 12.06.2015. In response to the said show cause notice, the petitioner submitted her explanation dated 15.07.2015.

According to the learned counsel for petitioner, panchanama was conducted on 13.05.2015 and the stock was seized. However, despite lapse of nearly 2 years, the 4th respondent - Joint Collector, Guntur, has not completed the enquiry initiated under Section 6-A of the Act. 4.

Heard Sri Gaddam Srinivas, learned counsel for the petitioner and the learned Government Pleader for Civil Supplies appearing for the respondents.

Having heard learned counsel for the respective parties, this Court is of the opinion that ends of justice would be served, if the 4th respondent - Joint Collector, Guntur, is directed to complete the enquiry initiated against the petitioner under Section 6-A of the Act and pass appropriate orders in accordance with law within a period of two months from the date of receipt of a copy of this order. 6.

Subject to the above direction, this writ petition is disposed of. As a sequel, Miscellaneous Petitions pending consideration, if any, in the Writ Petition shall stand closed. No order as to costs.
