SMT JUSTICE T.RAJANI CRIMINAL PETITION No.2741 OF 2018 ORDER:

This Criminal Petition is filed seeking for grant of anticipatory bail to the petitioner, who is accused, in an un-registered Crime before the Station House Officer, I Town Police Station, Sai Nagar Colony, Chittoor, Chittoor District.

Heard the learned counsel for the petitioner, learned Public Prosecutor appearing for the respondent-State, and perused the record. 3.

Learned counsel for the petitioner submits though no crime is yet registered against the petitioner, he apprehends that a crime would be registered against the petitioner and she would be arrested, as the Police concerned are frequently calling the petitioner to the Police station. 4.

Learned Public Prosecutor contends that no complaint is yet lodged by any one concerned, against the petitioner. 5.

However, learned counsel submits that the petitioner apprehends that a crime would be registered, not only based on the fact that the petitioner is being called to the Police station, but also on the ground of issuance of legal notice to her by one K.Bharathi, through her advocate; wherein, she states that the petitioner, who was indebted to her, has issued a cheque and promissory note towards discharge of the legally enforceable debt and the said cheque was returned with an endorsement 'Funds Insufficient'.

Hence, considering the facts of the case, and also the nature of allegations against the petitioner, this Court feels it fit to direct the Police concerned that, in case of registration of any crime against the petitioner,

they shall not arrest the petitioner unless they comply with Section 41-A of Cr.P.C.

Accordingly, with the above observation, the Criminal Petition is disposed of.

As a sequel, the miscellaneous applications, if any pending, shall stand dismissed.
