THE HON'BLE SRI JUSTI CE SANJAY KUMAR CONTEMPT CASE No.620 OF 2019 ORDER:
The respondent is present in person.
This Contempt Case arises out of the order dated 28.02.2019 passed in Writ Petition No.348 of 2019 whereby the Revenue Divisional Officer, Sangareddy District, was directed to take action upon the petitioner's application dated 12.7.2017 in accordance with the due procedure within a time frame. Alleging that no action was taken, the writ petitioner filed this Contempt Case.
The named respondent filed a counter affidavit stating that he is no longer the officer concerned as he was transferred as the Revenue Divisional Officer, Hyderabad, but after receiving notice in this Contempt Case, he verified with the present Revenue Divisional Officer, Sangareddy, and came to know that the order passed in Writ Petition No.348 of 2019 was already complied with and an endorsement dated 18.4.2019 was issued, rejecting the request of the petitioner in terms of the application made by him.
A copy of the endorsement dated 18.4.2019 is placed on record. Perusal thereof reflects that, having considered the matter, the Revenue Divisional Officer, Sangareddy Division, rejected the request of the petitioner for conversion of land use. In the event the petitioner is aggrieved by the said endorsement, it is for him to seek redressal thereof by way of independent proceedings in accordance with law. The validity of the said endorsement cannot be made the subject matter of enquiry in contempt proceedings. The order stands duly complied with as necessary action, as deemed fit, has been taken upon the petitioner's application.
The Contempt Case is accordingly dismissed. No order as to costs. ----------------------- SANJAY KUMAR, J.
