HON'BLE SRI JUSTICE M.S.K. JAISWAL Criminal Petition No.353 of 2016 ORDER:

The petitioners, who are A-1 to A-6 in Crime No.233 of 2015 of Proddatur I Town Police Station, Kadapa District, registered for the offences punishable under Sections 420 and 506 read with Section 34 IPC, filed this Criminal Petition under Section 438 of Cr.P.C. seeking anticipatory bail.

It is alleged in the complaint given by the de facto complainant that there was a marriage settlement between the de f a c t o complainant and the 1st petitioner/accused through Shaadi.com and on account of such marriage settlement, the parents of the de facto complainant paid one lakh rupees and also a gold ring as per their demand at the time of engagement, which was performed on 05-03-2015. Thereafter, both the families used to visit vice-versa.

Later as per the demand of the petitioners/accused, the parents of the de facto complainant also paid an amount six lakhs of rupees towards dowry. Thereafter, the petitioners/accused are not willing to perform the marriage of the 1st petitioner/accused-1 with the de facto complainant and thereby cheated not only the de facto complainant, but also her family. On coming to know the same, the de facto complainant made a complaint to the police of Proddatur I Town Police Station, which was registered as Crime No.374 of 2015 for the offences punishable under Sections 420 and 509 read with Section 34 IPC. A perusal of the complaint and the material on record disclosed that there are specific overt acts for the alleged offences against the petitioners/accused. It is to be stated that the

investigation is in process and not yet completed. In that view of the matter, it is not a fit case where the extraordinary jurisdiction can be invoked to grant anticipatory bail. Hence, I am not inclined to grant any anticipatory bail as sought for and the Criminal Petition is liable to be dismissed.
