O R D E R

This Criminal Petition is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioners, who are arrayed as accused Nos.2 and 3 in Crime No.43 of 2026 on the file of Chityal Police Station, Jayashankar Bhupalpally District, registered for the offences punishable under Sections 69, 296(b), 351(2) of the BNS, Section 3(1)(r)(s), 3(2)(v), 3(1)(w)(ii) of the SC/ST (POA) of the Amendment Act, 2015.

The case of the prosecution is that the de facto complainant came to the police station and lodged a report before police on 12.03.2026, wherein it is stated that accused No.1 deceived her on the pretext of love and stating so he forcibly had physical relationship with her at her house. It is stated that since accused No.1 denied to marry her and when she went to the house of the accused, A.1 along with his parents A.2 and A.3 abused her in the name of caste and threatened her with dire consequences. Hence, she requested the police to take necessary action against the said complaint. Basing on the same, police registered a case against the accused for the aforesaid offences.

Learned counsel for the petitioners-accused Nos.2 and 3 would submit that the petitioners are innocent of the offences alleged against the petitioners; that all the offences are allegations against accused No.1 only; that accused No.1 is already arrested, the custodial interrogation of these petitioners is not required; that except stating that these petitioners supported accused No.1 for commission of offence, there is no other allegation against these petitioners to constitute any of the

offence and hence, requested this Court to grant Anticipatory Bail to the petitioners.

On the other hand, learned Additional Public Prosecutor opposed the same and submits that the offences alleged against the petitioners are heinous and grievous in nature; that there is an offence of SC/ST is also registered against these petitioners and hence, they are not entitled for grant of bail and hence, he prays to dismiss the petition. 6.

Considering the submissions made by learned counsel for both parties and perusal of the material on record, it appears the only allegation against these petitioners is that they cooperated with A.1 for commission of alleged offence. Further, Accused No.1 is also refused to marry the complainant on the ground of caste. Except these allegations, prima facie there is no allegation to constitute the offence under SC/ST POA Act. Considering the above aspects and as Accused No.1 is in judicial custody, the custodial interrogation of these petitioners is not required in this case, this Court is inclined to grant bail to the petitioners subject to the following conditions: (i) The petitioners-accused Nos.2 and 3 shall surrender before the Station House Officer, Chityal Police Station, Jayashankar Bhupalpally District, within two (2) weeks from today, and on such surrender, the petitioners shall be released on bail on executing a personal bond for a sum of Rs.25,000/-

(Rupees Twenty Five Thousand only) each with two sureties for a like sum each.

(ii) On such release, the petitioners shall appear before the concerned Investigating Officer on every Wednesday between 09:00 a.m, and 05:00 p.m., for a period of eight (8) weeks or till the filing of the charge sheet, whichever is earlier, and thereafter, as and when required.

(iii) The petitioners shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
