Ramasubramanian) Heard the learned counsel for the petitioner, learned Standing Counsel for the banks and the learned counsel for the auction purchaser.
2. It appears that the appeal filed by the petitioner before the Debts Recovery Tribunal under Section 17 of Securitisation and Reconstruction of Financial Assets and Enforcement of Security on Interest Act, 2002 (in short 'Securitisation Act') was with a delay and the Tribunal seems to have condoned the delay by an order passed on 30.04.2019. In the light of such a development, the petitioner cannot be allowed to ride two horses.
