Puligolla Gunnaiah, v. The State Of A.P.,
THE HON'BLE SRI JUSTICE C.V. NAGARJUNA REDDY WRIT PETITION NO.35374 OF 2015 DATED:16-11-2015 Between:
Puligolla Gunnaiah and another ... Petitioners And The State of A.P.
Rep. by its Principal Secretary Municipal Administration Department Secretariat Hyderabad and another ... Respondents ... Respondents COUNSEL FOR THE PETITIONERS: Mr. V. Sreemannarayana COUNSEL FOR RESPONDENT NO.1: A.G.P. for Municipal Administration (AP) COUNSEL FOR RESPONDENT NO.2: Mr. S.D. Goud, Standing Counsel
THE COURT MADE THE FOLLOWING:
ORDER:
The inaction of respondent No.2 in assigning new door numbers to an old shed and a hut in which the petitioners are residing, is questioned in this writ petition. Mr. S.D. Goud, learned Standing Counsel for Tirupati Municipal Corporation, on instructions submitted that the petitioners are in long standing possession of the property, that some dispute exists between two third parties and the litigation is pending and that, however, the petitioners are not a party thereto. The petitioners have filed photographs which show that a very old shed and a hut are in existence. It
is not in dispute that the shed and hut were assigned door numbers when they were under the administrative control of the Gram Panchayat concerned and that recently they were included in respondent No.2 Corporation. In the light of the above facts, I do not find any justification for respondent No.2 in not allotting new door numbers to the shed and the hut consequent on their inclusion in the Corporation area. Accordingly, respondent No.2 is directed to allot new door numbers to the shed and the hut.
Subject to the above directions, the writ petition is disposed of. As a sequel to disposal of the writ petition, W.P.M.P. No.45456 of 2015 shall stand disposed of as infructuous.
