HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.8921 of 2019 ORDER:

This writ petition is disposed of at the stage of admission with the consent of both the parties.

This writ petition is filed seeking the following relief :- " ...... to issue an appropriate writ, order or direction more in the nature of Mandamus, declaring the impugned proceedings of the 3rd respondent in No.A/ 922/ 2019, dated 1.9.2019 served on 6.10.2019 whereby the petitioner was removed from service of Village Revenue Assistant temporarily as being illegal, arbitrary and against the principles of natural justice and violative of Articles 14, 16, 21 and 301 of Constitution of India and consequently set aside the same ....." .

Heard Mr.V.Brahmaiah Chowdary, learned counsel for petitioner and the learned Assistant Government Pleader of Services-I.

It has been contended by the petitioner that he was appointed as Village Revenue Assistant of Tammavaram Village, Chintalapalem Mandal, Suryapet District, and he has been discharging his duties to the best satisfaction of his superiors and every one concerned.

The grievance of the petitioner is that the respondents have placed him under suspension vide proceedings dated 01.09.2018 on the alleged ground that he has showed the land Ac.3-00 gts., which belonged to the Government, in the name of one private individual.

Learned counsel for the petitioner has contended that though six months have lapsed, the respondents are not reviewing the suspension order nor concluding the enquiry initiated against the petitioner. Therefore, appropriate orders be passed in the writ petition directing the respondents to review the suspension order strictly in terms of G.O.Ms.No.86, dated 08.03.1994. Learned Government Pleader appearing for respondents has contended that the respondents will review the suspension order in terms of G.O.Ms.No.86 dated 08.03.1994 and appropriate orders would be passed.

This Court, having considered the rival submissions, is of the considered view that this writ petition can be disposed of directing the respondents to review the suspension order of the petitioner in terms of G.O.Ms.No.86 dated 08.03.1994 and pass appropriate orders within a period of eight weeks from the date of receipt of a copy of this order.

With the above observations, the writ petition is disposed of. No order as to costs.
