The petitioner has been doing rice mill business for the past 35 years. The petitioner states that the Kakinada Agricultural Market Committee was bifurcated into two market committees one at Peddapuram and another at Samarlakota in the year 2000. The petitioner is the licence holder of Peddapuram Agricultural Market Committee. While so, the third respondent herein issued a notice dated 04.08.2014 demanding the payment of market fee of an amount of Rs.79,030/- for the year 2002-2003 for the sale of rice. Challenging the same, the present writ petition is filed. Learned counsel for the petitioner submits that the petitioner was not the licence holder of the third respondent Market Committee during the relevant year 2002-2003 as the Kakinada Agricultural Market Committee was already bifurcated by then.
However, since the impugned notice is only a show cause notice, this Court is not inclined to go into the said aspect of the matter. It is open to the petitioner to submit its explanation to the show cause notice issued by the third respondent by raising appropriate grounds including the ground of jurisdiction within fifteen (15) days from the date of receipt of a copy of this order.
Accordingly, this Writ Petition is disposed of. There shall be no order as to costs.
Miscellaneous petitions pending, if any, in this writ petition shall stand closed.
