HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN Writ Petition No.20091 of 2011 ORDER:

The relief sought for in this Writ Petition is to call for the records relating to the order passed by the 1st respondent on 06.07.2011, rejecting the 1st petitioner's application for permission to start Diploma in Elementary Education (D.El.Ed) course in the 2nd petitioner-College for the academic year 2011-12, and to declare them as arbitrary and illegal.

The petitioners sought permission of the N.C.T.E to start an additional course viz D.El.Ed course in the 2nd petitioner-College for the academic year 2011-12. The 2nd respondent is said to have issued letters dated 09.12.2010 and 07.01.2011 directing the 2nd petitioner to comply with certain deficiencies. The petitioners claim to have rectified the deficiencies. However the 2nd respondent, by order dated 11.04.2011, rejected the petitioners application for additional course i.e D.El.Ed on the ground that they were recognized only on 30.08.

2008, and had not completed three academic years as per Clause 8(3) of the National Council for Teacher Education (Recognition Norms and Procedure) Regulations, 2009 which requires every institution, which intended to start a course, to apply to the Regional Committee constituted under Section 20 of the Act; and for the Regional Committee, if it was satisfied that the conditions specified in Sections 14 and 15 were fulfilled, to grant recognition. The 2nd respondent, however, rejected the application of the petitioners. Aggrieved thereby, the petitioners preferred an appeal to the 1st respondent which, by order dated 06.07.

and rejected the petitioners appeal holding that the 2nd petitioner would become eligible for submission of applications for D.El.Ed course only in the year 2012. On the petitioners invoking the jurisdiction of this Court, interim direction as prayed for was granted in WPMP No.24344 of 2011 dated 29.08.2011, and the respondents were directed to consider the petitioners request for grant of permission to start D.El.Ed course in the academic year 2011-12.

While both Sri S.Srinivas Reddy, Learned Counsel for the petitioners, and Sri K.Ramakanth Reddy, Learned Standing Counsel for the respondents, express ignorance as to what transpired thereafter, the fact remains that the permission sought for is to conduct a course in the academic year 2011-12, which expired nearly six years ago. It is evident, therefore, that the cause in the Writ Petition does not survive necessitating any further adjudication by this Court.

The Writ Petition fails and is, accordingly, dismissed. The Miscellaneous Petitions pending, if any, shall also stand closed. No order as to costs.
