HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No. 17078 OF 2013 ORDER:

The present writ petition challenges the alleged action of the respondent in calling the petitioner to the police station in civil disputes. The sum and substance of the case is that the respondent is calling the petitioner to the police station for settlement of a civil dispute and the said conduct is unsustainable and violative of fundamental rights guaranteed under Article 21 of the Constitution of India.

This Court, while ordering Rule Nisi on 18.06.2013, granted interim order in WPMP.No.20729 of 2013 directing the respondent not to call the petitioner to the police station without there being a crime registered against him. So far, no counter has been filed denying the averments made in the affidavit filed in support of the writ petition and justifying the impugned action. In view of the same, this Court has no option except to dispose of the writ petition basing on the material available. Accordingly, the writ petition is disposed of making the interim order, dated 18.06.2013, as final order, in the absence of any counter by the respondent, directing the respondent not to call the petitioner to the police station except in accordance with law. Miscellaneous petitions, if any, shall also stand disposed of. No order as to costs.
