HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO COMPANY PETITION No.210 of 2012 ORDER:

This Company Petition was filed seeking winding up of the respondent-Company on the alleged ground of non-payment of balance amount due under the work "construction of Courtyard Hotel for Viceroy Hotels Limited at Hyderabad and work order for Window Glazing Systems".

It appears that a major portion of the amount was already paid and when the matter was taken up on the last occasion, only an amount of Rs.10,00,000/- remains and the petitioner expressed its willingness to receive the said amount in full and final settlement by foregoing the interest, which worked out to more than Rs.2 crores. Today, when the matter is taken up for consideration, learned counsel for the respondent handed over a cheque bearing No.005016, dated 13.12.2016, for the amount of Rs.10,00,000/- drawn on Kotak Mahindra Bank in favour of the petitioner. Learned counsel for the petitioner received the said cheque subject to realization and in view of the payment of the amount by way of the said cheque, he submitted that the present Company Petition may be closed.

The Company Petition is accordingly closed.
