HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 13762 of 2017 ORDER:
Letter dated 09.03.2017, intimating the petitioner about the shortfall which disable the respondent - authorities to consider the building permission, is challenged before this Court. In the impugned letter, various objections have been raised by the respondent - authorities primarily, in relation to the ownership rights of the petitioner in respect of which he seeks building permission.
It is the specific contention of the learned counsel for the petitioner that, on account of certain land being taken over by Alwal Gram Panchayat, as is evident from the resolution dated 27.08.1982 filed by the petitioner, certain portion of land, over which petitioner is seeking to make construction, has been given to him, as such, he is not having any documents; the fact that the petitioner had given land in favour of the Gram Panchayat and, subsequently, it was converted into municipality is evident from the judgment and decree in O.S.No.2052 of 2005 passed by the IV Additional Senior Civil Judge, Fast Track Court, Ranga Reddy District at L.B.Nagar; all these aspects were set out in the letter dated 28.10.2016 which the respondent - authorities failed to consider; and, in those
circumstances, prays for re-consideration of the application of the petitioner for building permission.
Sri Chatla Madhu, learned Standing Counsel for respondent Nos.2 and 3, submits that, if such is the case, respondent - authorities would have no objection to reconsider the application of the petitioner. In the circumstances, liberty is given to the petitioner to resubmit a detailed explanation, including the material to support his claim in response to the shortfall letter dated 09.03.2017, and the respondent - authorities shall consider the same within a period of four weeks from the date of receipt of a copy of this order.
The Writ Petition is disposed of accordingly. Miscellaneous petitions pending, if any, shall stand dismissed. No order as to costs.
