THE HON'BLE SRI JUSTICE D.V.S.S.SOMAYAJULU Civil Revision Petition No.2614 of 2010 O R D E R:

This revision petition is filed questioning the order dated 10.6.2010 passed in IA.No.721 of 2009 in O.S.No.2775 of 2004 by which the delay of 1175 days in the application filed to set aside the ex parte decree and judgment was not condoned. The lower Court held that the delay is not satisfactorily explained. When this application is taken up for hearing, learned counsel for the respondents stated that the final decree was already passed on 27.9.2010. In view of this, both the counsels agree that this civil revision petition does not survive for consideration.

Therefore, this Court holds that no cause of action survives. Hence, the Civil Revision Petition is dismissed. No order as to costs.
