THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 10773 of 2016 ORDER:

The prayer of the petitioner in this case is as under: "The Hon'ble Court may be pleased to issue order direction more particularly one in the nature of writ of MANDAMUS declaring the action of the respondent police in arresting the petitioner in connecting with FIR.No. 84/2016 on the file of 4th respondent P.S as illegal, arbitary and contrary to the provisions of Cr.P.C. and consequentially direct the Respondent No.2 to 4 not to arrest the petitioner in connecting with FIR.No. 84/2016 on the file of 4th respondent P.S and pass such other order or orders may deem fit and proper in the circumstances of the case."

The Sub-Inspector of Police, RGI Airport Police Station, Cyberabad, furnished written instructions dated 20.04.2016 to the office of the learned Government Pleader for Home wherein he stated that upon the complaint lodged by Ch.Hari Chandra Prasad Reddy, Sub-Inspector of Police, RGI Airport Police Station, Cyberabad, Crime No.84 of 2016 was registered under Sections 420, 468 and 471 IPC read with Section 24 of the Immigration Act, 1924, on the file of RGI Airport Police Station, Cyberabad. During the course of the investigation, the Police was stated to have examined the complainant and recorded his statement. Investigation was stated to be still in progress. Insofar as the petitioner is concerned, the Sub-Inspector stated that the name of the petitioner is not mentioned in the FIR, but investigation is still going on and if any information was revealed about the involvement of the petitioner in the offence, action would be taken against him duly following the prescribed procedure.

In the light of the afore-stated stand of the police authorities, which is duly taken on record, this Court sees no reason to entertain this writ petition for adjudication on merits.

4. Sri K.L.N.Swamy, learned counsel representing Sri P.R.K.Amarender Kumar, learned counsel for the petitioner, is also agreeable to the closure of the case recording the stand of the police.

The Writ Petition is accordingly closed. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order.

No order as to costs.
