2015-02-04Vilas V.Afzulpurkar3 pages

HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.730 of 2015 ORDER:

Heard.

The grievance of the petitioner is that though the case was registered as Cr.No.211 of 2012 on 19-06-2012, neither investigated the case nor filed final report/charge-sheet by the 3rd respondent, in spite of lapse of more than two and half years. Learned Government Pleader has received instructions, which state that the petitioner's complaint was referred to the 3rd respondent by the XV Metropolitan Magistrate, Cyberabad, based on which, a case in Cr.No.211 of 2012 was registered on 19-06-2012 and took up investigation. It is also alleged that while the investigation is pending, the 4th respondent herein against whom the petitioner made a complaint, also filed a private complaint against the petitioner and two others, which was referred to the 3rd respondent by the XV Metropolitan Magistrate, Cyberabad, based on which, a case in Cr.No.

273 of 2012 was registered on 13-08-2012, wherein the petitioner is shown as A3. It is further stated that so far as Cr.No.273 of 2012 is concerned, the same was already referred as 'false case' and a final report was filed before the jurisdictional Court. In so far as Cr.No.211 of 2012, which was registered on the petitioner's complaint, is concerned, it is stated that due to change of investigating officers, there was a delay in completing the investigation. However, the 3rd respondent assured that investigation will be completed expeditiously and final report/charge-sheet will be filed before the jurisdictional court without any further loss of time.

In view of that, the writ petition is disposed of directing the 3rd respondent to complete the investigation and file final report/charge-

sheet before the jurisdictional court expeditiously preferably within three months from the date of receipt of a copy of this order. No order as to costs.

The miscellaneous petitions, if any, pending in this writ petition shall stand closed.
