Heard both sides. With the consent of both parties the writ petition is disposed of at the admission stage. The present writ petition is filed seeking issuance of writ of Mandamus declaring the action of respondent Nos.3 and 4 in coercing and threatening the petitioner to depose/ give statement before the concerned Magistrate in Crime No.02/ RCA/ CIU/ ACB/ 2017, registered for the offences punishable under Sections 13(1)(e) read with Section 13(2) of Prevention of Corruption Act, as illegal and arbitrary. Though various grounds are raised, learned counsel for the petitioner submits that respondent Nos.3 and 4 are pressurizing, threatening and coercing the petitioner to give statement in the manner they wanted.

The same is disputed by the learned Standing Counsel for ACB stating that no such threat or force is being used on the petitioner to give statement in the manner suggested by respondent Nos.3 and 4. Recording the statement made, the writ petition is disposed of directing respondent Nos.3 and 4 not to coerce or threaten the petitioner to give statement in the manner suggested by them and the petitioner is always at liberty to give the statement under Section 164 of Cr.P.C. in the manner he wants. But, however, the petitioner shall co-operate with the investigation in Crime No. 02/ RCA/ CIU/ ACB/ 2017 and the respondents shall follow due process of law while summoning the petitioner. No costs.

CPK, J W.P.No.4220 of 2017 As a sequel thereto, Miscellaneous Petitions, if any, pending in this Writ Petition, shall stand closed.
