SMT JUSTICE T.RAJANI CRIMINAL PETITION No.2745 OF 2018 ORDER:

This Criminal Petition is filed seeking for grant of anticipatory bail to the petitioner, who is accused No.9, in Crime No.16 of 2018 on the file of the Station House Officer, Chunchupalli Police Station, Bhadradri Kothagudem District. The offences alleged initially are under Sections 143, 147, 324 and 506 R/w.149 of I.P.C. and, during the course of investigation, altered the Sections of law to 148, 307, 506 and 109 R/w.149 of I.P.C.

Heard the learned counsel for the petitioner, learned Public Prosecutor appearing for the respondent-State, and perused the record. 3.

Learned Public Prosecutor brings to the notice of the Court that the earlier bail Petition filed by the petitioner was dismissed by this Court by virtue of the orders in Criminal Petition No.2012 of 2018 on 27.02.2018. 4.

A perusal of the order shows that considering the merits of the case, the aforesaid Petition was dismissed by this Court. Hence, in the light of the above, this Petition is not maintainable. 5.

However, considering the request of the petitioner's counsel that a specific direction be given to the petitioner surrender before the V Additional Sessions Judge at Kothagudem, instead of the Court having jurisdiction, the petitioner is directed to file a Petition seeking for regular bail by surrendering himself before the V Additional Sessions Judge at Kothagudem. Thereafter, the learned V Additional Sessions Judge at Kothagudem shall dispose of the bail application, on merits, expeditiously, preferably on the same day, subject to pressure of other work.

Accordingly, with the above observation, the Criminal Petition is dismissed.

As a sequel, the miscellaneous applications, if any pending, shall stand dismissed.
