THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION Nos.27069 & 28334 of 2012 COMMON ORDER:

These two writ petitions, under Article 226 of the Constitution of India, are filed by the petitioners seeking to declare the action of the respondents in issuing notification, dated 17.08.2012 for the recruitment of shramiks by insisting to produce the NAC certificate for getting benefit of upper age relaxation of four years to the candidates who have completed apprenticeship in APSRTC is illegal and arbitrary and consequently direct the respondent to consider the cases of the petitioners for appointment to the post of "Shramik" in the recruitment of 2012 by giving age relaxation of four years without insisting NAC certificate.

2. Heard Sri P. Venkateshwer Rao, learned counsel for the petitioners and Sri N. Vasudeva Reddy, learned Standing Counsel for the respondent.

Learned counsel for the petitioners submits that pursuant to the interim order granted by this Court on 31.08.2012, respondents permitted the petitioners to participate in the selection process, and however, their results have not been declared. Therefore, learned counsel submits that appropriate orders be passed directing the respondents to declare the results of the petitioners and if they are coming within the zone of consideration for appointment to the post of Shramik, to consider their cases.

4. Learned Standing Counsel for the respondents contended that the respondents would consider the cases of the petitioners if they come within the zone of consideration.

5. This Court, having considered the rival contentions made by the parties, is of the view that this writ petition can be disposed of directing the respondents to declare the results of the petitioners and if the petitioners are coming within the zone of consideration for appointment to the post of Shramik, respondents shall consider their cases for appointment to the post of Shramik, and pass appropriate orders within a period of four (4) weeks from the date of receipt of a copy of this order.

6. With the above observations, the writ petitions are disposed of. No order as to costs. Miscellaneous applications pending if any shall stand closed.
