This Writ Petition is filed challenging the noticed issued by the 4th respondent on 22.1.2018 in exercising the powers conferred on him Under Section 7 of Land Encroachment Act, 1905. 2.

The petitioner states that his application for grant of house site patta for an extent of 0.14 cents in Survey No.698/2, Tirupathi Rural, Chittoor district, is pending.

Be that as it may, as on today, the proceedings issued Under Section 7 of Land Encroachment Act, 1905, by the 4th respondent are pending. Since it is a notice before taking final action, the petitioner has a right to file his objections to the said notice. 4.

In view of the same, this Court is not inclined to interfere with the proceedings before the 4th respondent at this stage. 5.

The Writ Petition is accordingly, disposed of giving liberty to the petitioner to file his objections pursuant to the notice dated 22.1.2018, within a period of seven days from the date of receipt of a copy of this order and the 4th respondent is restrained from evicting the petitioner without passing final order, if not already passed.

Pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
