THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.17949 OF 2016 ORDER:

The petitioner society is registered under the Society Registration Act and dealing with execution of electrical works in connection with 11 K.V., feeder maintenance in Visakhapatnam Agency area. A-Grade licence was granted in the name of President of the petitioner-society and he has been carrying out the works on franchise basis for the past fifty years and there are no complaints whatsoever.

2. The 2nd respondent had issued Memo, dated 12.05.2016, pursuant to the orders passed by the 1st respondent, granting approval for franchising of feeders and directed the 3rd respondent to initiate necessary action for entering into MOU by following departmental procedures.

3. The petitioner, being eligible to undertake the said work, had submitted a representation on 24.05.2016 to the 1st respondent by marking copies to respondents 2 and 3. But, no action has been taken till date.

4. Heard learned counsel for the petitioner as well as learned Standing Counsel for the respondent Corporation.

5. Learned Standing Counsel for the respondent-Corporation submits that a direction may be issued to the authorities concerned to consider the representation, dated 24.05.2016 submitted by the petitioner on its own merits.

6. Accordingly, the Writ Petition is disposed of directing the respondent-Corporation to consider the representation, dated

24.05.2016, submitted by the petitioner for allotting the work subject to technical competency, eligibility and other commercial parameters. There shall be no order as to costs.
