HONOURABLE SRI JUSTICE A. SHANKAR NARAYANA TRANSFER C.M.P. No.559 OF 2017 ORDER:

Heard Mrs. Nimmagadda Revathi, learned counsel for the petitioner, and Sri P. Rahul, learned counsel, representing Sri Rajagopallavan Tayi, learned counsel for the respondent, and perused the material on record.

2. The present Transfer Civil Miscellaneous Petition is filed requesting for withdrawal of H.M.O.P. No.71 of 2017 from the file of the learned Principal Senior Civil Judge, Chittoor, Chittoor District, and to transfer the same to the Court of the learned Senior Civil Judge at Rajampet, Kadapa District.

3. Admittedly, the petitioner is wife of the respondent, who filed H.M.O.P. No.71 of 2017 for restitution of conjugal rights, and she resides at Rajampet, Kadapa District, where the learned Senior Civil Judge's Court is also located, whereas, the respondent resides beyond the municipal limits of Chittoor town.

4. Though, the present application is pending for the past more than six (6) months, no counter is filed resisting or raising any tenable objections by the respodnent.

5. Keeping in view, the hardship that would be met by the petitioner to travel all the way to Chittoor, considering that the request is reasonable, the Transfer Civil Miscellaneous Petition is allowed.

ASN,J TrCMP No.559 of 2017 The H.M.O.P. No.71 of 2017 is withdrawn from the file of the learned Principal Senior Civil Judge, Chittoor, Chittoor District, and transferred the same to the Court of the learned Senior Civil Judge at Rajampet, Kadapa District, for trial and disposal.

6. As a sequel thereto, Miscellaneous Petitions, if any, pending in the present transfer civil miscellaneous petition stand closed. __________________________ A. SHANKAR NARAYANA, J March 22, 2018.
