These two Writ Petitions are being disposed of by this common order after hearing the learned counsel for the petitioners, learned Government Pleader and learned Standing Counsel for the 4th respondent.

Writ Petition No.7328 of 2018 is filed challenging the order dated 27.4.2016 passed by the 3rd respondent amending the record of rights in respect of agricultural land of an extent of Ac.1.38 guntas situated in Survey No.809 of Hanmakonda Village and Mandal, Warangal district in favour of the 4th respondent temple. 3.

Writ Petition No.7335 of 2018 is filed challenging inaction of the 2nd respondent, Revenue Divisional Officer, Warangal District, in not passing any orders on the application of the petitioners dated 25.8.2015, 6.1.2016 and 18.1.2016 under the provisions of the Inam Abolition Act for issuance of Occupancy Rights Certificate in respect of the above land.

Learned counsel for the petitioners submits that the proceedings for issuance of Occupancy Rights Certificate are pending before the 2nd respondent and when they were pending, at the instance of the 4th respondent, the 3rd respondent passed the impugned order amending the record of rights on 27.4.2016 and it is illegal.

This Court noticed that against the order passed by the 3rd respondent dated 27.4.2016, there is a provision for appeal and they could have availed the same. If the petitioners so choose, they are given 30 days time from today for availing such remedy and in the meanwhile, there shall be status-quo with regard to the entries in the Revenue Records.

Since the rights of the parties will be dependent upon the proceedings before the 2nd respondent, the 2nd respondent is directed to dispose of the proceedings for issuance of Occupancy Rights Certificate in respect of the above land as expeditiously as possible but not later than three months from the date of receipt of a copy of this order after hearing the petitioners as well as the 4th respondent.

The Writ Petitions are accordingly, disposed of. Pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
