THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37305 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed seeking to declare the action of 2nd respondent in registering Crime No.226 of 2016, as illegal and arbitrary.

Heard and perused the material available on record. The grievance of the petitioners is that the 3rd respondent lodged the present complaint alleging that the 1st petitioner married her and they both lead happy marital life without disputes for about three months and later, the 1st petitioner along with his family members used to harass the 3rd respondent mentally and physically and demanded additional dowry. Basing on the said complaint, the 2nd respondent registered the above said crime.

Considering the grievance of the petitioners, the 2nd respondent is directed to complete the investigation in Crime No.226 of 2016 as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioners. Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO, J Date: 2nd November, 2016 KL
