THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN Arbitration Application Nos.80, 81 and 82 of 2016 ORDER:
This Court, by its common order dated 06.01.2017, recorded the consent of both Sri K.Siddharth Rao, Learned Counsel for the applicant and Mrs.Shailaja Arun Deekshit, Learned Counsel for the respondent, that a retired District Judge be appointed as the sole arbitrator to resolve the disputes between the parties in all these three applications; and, accordingly, appointed Sri M.Lakshmi Narayana, retired District Judge as the sole arbitrator to resolve the disputes between the parties. Sri M.Lakshmi Narayana, retired District Judge, addressed a letter to this Court, (a copy of which was received on 15.04.2017), informing that, since he was appointed as the Chairman of the Permanent Lok Adalat for Public Utility Services, Chittoor on 16.03.2017, he was unable to proceed with the arbitration.
It is, therefore, necessary that another arbitrator be appointed in his place. I consider it appropriate to appoint Sri G. Gopala Krishna Murthy, retired District Judge, H.No.3-4-756/1, Flat No.102, Sai Raghavendra Residency, Barkathpura, Hyderabad - 500 027, as the sole arbitrator. The Learned arbitrator shall fix his remuneration, and incidental charges for the arbitration proceedings, in consultation with the parties. He shall complete arbitration proceedings, and pass an award at the earliest, preferably within a period of six months from the date of commencement of arbitral proceedings. He is also requested to hold sittings, as far as possible, in the mediation centre of the High Court.
All these three Arbitration Applications are, accordingly, disposed of. The miscellaneous petitions pending, if any, shall also stand disposed of. There shall be no order as to costs. ________________________________ RAMESH RANGANATHAN, ACJ Date:02.06.2017 cs
