HONOURABLE SRI JUSTICE SANJAY KUMAR AND HONOURABLE SRI JUSTICE T.AMARNATH GOUD WRIT PETITION Nos.8943 and 8969 of 2019 COMMON ORDER: (per Hon'ble Sri Justice Sanjay Kumar) The District Manager, Telangana State Civil Supplies Corporation Limited, Karimnagar, filed these Writ Petitions assailing the individual orders dated 22.12.2017 passed by the Chief Judicial Magistrate (Assistant Sessions Judge), Karimnagar, in exercise of power under Section 14 of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002, in Crl.M.P.Nos.98 and 99 of 2017.
These orders were passed authorising the secured creditor in these cases to take possession of the premises of the secured assets offered by the borrower, respondent No.3, in each of these cases. No interim orders were granted in either of these Writ Petitions.
Sri M.Srinivas, learned counsel, representing M/s ASREC (India Limited), respondent No.2, would inform this Court that the impugned orders in these cases were already given effect to and after securing possessing of the secured assets, they were also brought to sale successfully. He would further state that the sale certificates were also issued to the auction purchaser in February, 2019.
In the light of these developments, the cause in these Writ Petitions in relation to the impugned orders passed under Section 14
SK, J & TA, J WP.No.8943 & Dt:26.6.2019 of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002, no longer survives for consideration on merits.
The Writ Petitions are accordingly dismissed leaving it open to the petitioner to take recourse to appropriate remedies available to it in accordance with law.
Pending Miscellaneous Petitions, if any, shall also stand dismissed. No order as to costs.
