HONOURABLE SRI JUSTICE SANJAY KUMAR CRIMINAL PETITION No.2301 of 2019 ORDER:

The petitioner is accused No.1 in Crime No.122 of 2018 on the file of Vijayapuri Town Police Station, Nalgonda District, registered under Section 409 I.P.C. By way of this petition filed under Section 438 Cr.P.C., the petitioner/accused No.1 seeks grant of anticipatory bail.

Sri S.Rahul Reddy, learned counsel for the petitioner/accused No.1, would assert that his client has been cooperating with the investigation and that he maybe granted pre-arrest bail on any condition thought fit by this Court.

It may be noted that the petitioner/accused No.1 is a Government servant and is alleged to have committed criminal breach of trust in relation to public funds. That being so and as the learned Assistant Public Prosecutor would inform this Court that the investigation is not completed, this Court is of the opinion that the petitioner/accused No.1, would not be entitled to grant of pre-arrest bail.
