HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.8906 of 2019 ORDER:

This writ petition is disposed of at the stage of admission with the consent of both the parties.

This writ petition is filed seeking the following relief :- " ...... to issue a writ, order, direction especially one in the nature of writ of Mandamus declaring the action of the Respondents in not continuing the Petitioner as Lascar as bad, illegal, arbitrary, unconstitutional and violative of Arts. 14 and 16 of the Constitution and also violative of orders passed in W.P.No.97 of 1988 and also the orders of the Hon'ble Supreme Court and further direct the Respondents to consider the representation dt.13.11.2018 for the Petitioner by accepting his residential certificate and appoint him as Lascar with all consequential benefits ....." . Heard Mr.G.Shiva representing Ms.K.Rajitha, learned counsel for petitioner and the learned Assistant Government Pleader of Services-II.

It has been contended by the petitioner that he was initially appointed as NMR Electrician with the respondents during the year 1984 and with the disbandment of Nagarjuna Sagar Project, his services were discontinued. Later, he has challenged the same in W.P.No.97 of 1988 and the said writ petition was disposed of. After disposal of the said writ petition, his services were re-engaged from 2010 onwards and ever since then, he has been discharging his duties as Lascar. As the respondents have doubted the residential certificate of petitioner, they have issued proceedings on 20.10.2017 asking him to submit residential certificate within seven days. He has secured fresh residential certificate on 06.10.2018 and submitted the same along with representation on 13.11.2018. But, so far, the respondents have not passed any orders on the said

representation by duly taking into account the latest residential certificate furnished by him.

Learned counsel for petitioner has contended that appropriate orders be passed in the writ petition directing the respondents to consider the representation submitted by the petitioner on 13.11.2018 by duly taking into account the latest residential certificate of the petitioner and pass appropriate orders in accordance with law.

Learned Government Pleader appearing for respondents has submitted that the case of the petitioner will be considered and appropriate orders would be passed on the representation submitted by the petitioner in accordance with law. This Court, having considered the rival submissions, is of the considered view that this writ petition can be disposed of directing the respondents to consider the representation submitted by the petitioner on 13.11.2018 and pass appropriate orders in accordance with law within a period of four weeks from the date of receipt of a copy of this order.

With the above observations, the writ petition is disposed of. No order as to costs.
