HON'BLE SRI JUSTICE V.RAMASUBRAMANIAN AND HON'BLE Ms. JUSTICE J.UMA DEVI Writ Petition No.7349 of 2018 Order: (per V.Ramasubramanian, J.) The limited prayer with which the dealer has come up wit the above writ petition is to direct the 1st respondent to refund the amount due as per the assessment order.
2. Heard Mr. S.Dwarakanath, learned counsel for the petitioner and Mr. Shaik Jeelani Basha, learned Special Standing Counsel for the respondents.
3. The amount became due as per the order of assessment dated 21-3-2016 for the period from 01-01-2015 to 31-3-2015. The amount is actually payable with interest under Section 38(6). Now a period of two years has elapsed.
4. The learned Special Standing Counsel stated on instructions that the refund is under process. Therefore, the writ petition is disposed of directing the 1st respondent to process the refund at the earliest and make payment within a period of 6 (six) weeks from the date of receipt of a copy of this order. The miscellaneous petitions, if any, pending in this writ petition shall stand closed. No costs.
