THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.7386 of 2018 ORDER:

With the consent of learned Counsel for the respective parties, this Writ Petition is disposed of at the admission stage.

This Writ Petition is filed seeking the following relief: ".........to issue Writ of Mandamus by declaring the action of the respondent No.4's impugned proceedings No.616/MEPMA/Allegations, dated 08.01.2018 for suspension of the petitioner basing on the article published in Daily Newspapers, dated 04.01.2018 without conducting any enquiry as illegal, arbitrary, and violation of principles of natural justice and consequently set aside the impugned proceedings No.616/MEPMA/Allegations, dated 08.01.2018, issued by the respondent No.4 ....."

Heard Sri K.Buchi Babu, learned counsel for the petitioner, the learned Government Pleader for Services-III and Sri T.Chandra Sekhar Rao, learned Standing Counsel for R.4.

It has been contended by the petitioner that she is working as a Community Organizer with the respondents and she has been discharging her duties to the satisfaction of her superiors and everyone concerned. The petitioner further submits that the respondent No.4 placed her under

WP.7386/2018 AKS,J suspension vide Orders, dated 08.01.2018 based on an article published in the Daily Newspapers on 04.01.2018. The petitioner further submits that she was falsely arrested in connection with a criminal case and was detained for more than 48 hours in F.I.R.No.233 of 2017. Since the petitioner was detained for more than 48 hours, respondent No.4 has placed her under suspension and the respondents have not reviewed the suspension order. Therefore, learned Counsel for the petitioner submits that appropriate Orders be passed in the Writ Petition to review the suspension of the petitioner strictly in terms of G.O.Ms.No.86, dated 08.03.1994.

The learned Government Pleader as well as the learned Standing Counsel had submitted that the case of the petitioner would be reviewed strictly in terms of G.O.Ms.No.86, dated 08.03.1994, and appropriate orders would be passed in accordance with law.

Having regard to the submissions made by the learned Counsel for the respective parties, this Court is of the considered view that the Writ Petition can be disposed of directing respondent No.4 to review the suspension orders of the petitioner strictly in terms of G.O.Ms.No.86, dated 08.03.1994 and pass appropriate Orders in accordance with law within a period of four weeks from the date of receipt of a copy of this Order.

Accordingly, the Writ Petition is disposed of. No costs.

As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
