THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.5632 OF 2017 ORDER:
Heard learned counsel for the petitioner/A2 of Crime No.45 of 2010 of Tirumala II Town Police Station, Tirupathi, Chittoor District, for the offences punishable under Sections 408, 420, 467, 468, 471, 477 and 120B of IPC along with other accused and also the learned Public Prosecutor, representing for the 1st respondent - State, before ordering notice to the 2nd respondent - defacto complainant and perused the grounds urged in the quash petition to quash the Crime No.45 of 2010 and the expression of the Apex Court in Pankaj Kumar Vs. State of Maharastra and others1 and perused the other material on record. 2.
Even from the expression and the decisions referred therein including the constitution bench of the Apex Court in P. Ramachandra Rao Vs. State of Karnataka2, there is no hard and fast rule invariably and each case depends upon own facts.

Having regard to the above and in the result, this Court feels it just to direct the Investigation Officer to complete the investigation and file final report within one month from the date of receipt of the order. Further grievance if any of the petitioner is left open after one month. 4.
Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence.
