THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.8210 of 2016 ORDER:
This Criminal Petition is filed by the petitioners/A-1 & A-2 under Section 438 Cr.P.C., seeking anticipatory bail in Crime No.73 of 2016, on the file of Saidapur Police Station, Karimnagar District, registered for the offences punishable under Sections 3(1)(r)(s), 3(2)(va) of SCs & STs (POA) Amendment Act, 2015.
Heard and perused the material available on record. The allegations against the petitioners are that on 03.06.2016 at about 10.00 hours, while the de facto complainant was performing agriculture work in her leased field, A-1 and A-2 trespassed into her leased land and abused and insulted her in the name of caste and threatened to kill her.
Learned counsel for the petitioners submitted that the petitioners are innocent of the offences alleged against them and they are falsely implicated in the case as there are some civil disputes between them and the owner of the land and that the incident occurred on 03.06.2016 at about 10.00 a.m., but the complaint is lodged on 05.06.2016 at about 8.00 p.m.
The learned Additional Public Prosecutor opposed this petition and submitted that in view of the nature of the offence, this petition for anticipatory bail is not maintainable.
Considering the facts and circumstances of the case and the submissions made by the learned Additional Public Prosecutor and in view of the nature of the offence, this Court is of the view that this petition is not maintainable.
Accordingly, the Criminal Petition is dismissed. ___________________ RAJA ELANGO, J
