Heard.
The petitioner claims to be in possession of front side ground floor portion of House Bearing No.25, GLR Survey No.457/180 at Karkhana Bazar, Secunderabad Cantonment.
The said property was obtained by the petitioner from its owners T.Shankar Yadav and G.Chandra Sekhar under a lease agreement dated 01.05.2014. He states that while the petitioner company is in possession and enjoyment of the said property and running its business from there, the officials of the respondent surveyed the said property on 20.11.2015 and erected the board that this is a Government land and had made marking in the property. Apprehending that their portion in their occupation will be demolished without notice, the present writ petition is filed. Learned standing counsel for the respondent Boarxd on instructions states that as on today no action is contemplated for demolition as alleged by the petitioner and as and when any action is taken, the Board will issue appropriate notice to the owners and occupier by following due process of law.
In view of the above instructions, the petitioner's apprehension about demolition of the property as on today does not arise and as and when the respondent corporation intends to take action, they shall follow the due process of law as referred to above, so that the petitioner will get advance notice and opportunity to submit explanation before any such action is taken. With the above direction, the writ petition is disposed of. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
