Petition filed under Sections 438 of Cr.P.C. praying that in the circumstances stated in the Grounds of Criminal Petition, the High Court may be pleased to grant anticipatory bail to the Pelitioners/Accused Nos. 1 and 2 in the event of lheir arrest in Crime No. 14 of 2018 on the file of the Vizianagaram Rural Police Station, Vizianagaram District. -- The petition coming on for hearing, upon perusing the memorandum of grounds {iled in support thereof and upon hearing the arguments of Sri lvlangena Sree Rama Rao, Advocate for the Petitioners and of Public Prosecuto(AP) on behalf of Respondent-State, the Court made the following ORDER:-

SMT. JUSTICE T,RAJANI CRIMINAL PETITIo No. 2796 OF 2018 ORDER:

This petition is filed, under Section 438 of the Code of Criminal Procedure, 1973 (for short, 'Cr.P.C.'), seeking for grant of anticipatory bail to the petitioners-accused Nos. 1 and 2 in Crime No. 14 of 2018 oF Vizianagaram Rural Police Station, Vizianagaram District, registered for the offences punishable under Section 420 IPC and Sections 3 and 4 of DP Act. 2.

Heard learned counsel for the petitioners and learned Public Prosecutor (A. P.) 3.

Learned counsel For the petitioners submits that accused Nos. 3 to 5 were already granted anticipatory bail by order dated 07-02-2078 in Criminal Miscellaneous Petition No. 41 of 2018 on the file of the Court of Sessions Judge, Vizianagaram. He also relies on the messages that were sent by the de facto complainant, which show that she, in fact, wanted to put an end to the relationship between herself and the petitioners. 4.

Hence, considering the above, this Court is inclined to grant anticipatory bail to the petitioners.

5. The petitioners are directed to surrender before the Station House Officer, Vizianagaram Rural Police Station, Vizianagaram District, within three weeks From the date oF this order. On such surrender, the petitioners shall be released on bail on their executing each a personal bond for a sum of Rs.50,000/- (Rupees fifty thousand only) with two sureties for a like sum each to the satisfaction of the said Station House

Officer. The petitioners are directed to appear before the Station House Officer, Vizianagaram Rural Police Station/ on every Saturday till 2B-04-2018 or till filing charge sheet whichever is earlier. The petitioners shall produce copies of their Aadhar/Identify Cards, Savings Bank Account Passbooks, Mobile Numbers and Property Particulars before the Additlonal Judicial lYagistrate of I Class, Vizianagaram, within three weeks from today. Further, on such release, the petitioners shall abide by the conditions mentioned under Section 438(2) Cr.P.C. as under: (i) The petitioners shall make themselves available For interrogation by a police oFficer as and when required.

(ii) The petitioners shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer;

(iii) The petitioners shall not leave India without the previous permission of the Court.
