THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 4319 of 2016 ORDER:

The prayer of the petitioner in this case is as under: "That this Hon'ble Court may be pleased to issue a Writ order or direction, more particularly one in the nature of Writ of Mandamus, declaring the inaction of the respondents 2 and 3 in not taking any action by investigating into the complaint in Crime NO.229/2015 Dt.09.09.2015 made by the writ petitioner against the 5th respondent as illegal, arbitrary and in violation of principles of natural justice, and consequently direct the 2nd and 3rd respondents to forthwith investigate into the complaint in Crime NO.229/2015 dated: 09.09.2015 made by the writ petitioner against the 5th respondent, and pass such other order or orders may deem fit and proper in the circumstances of the case."

2. The Deputy Superintendent of Police, S.C. & S.T. Cell-II, Kurnool District, filed a counter affidavit stating that upon the completion of the investigation in Crime No.229 of 2015, a final report referring the case as 'false' was proposed to be filed after getting due permission from the Superintendent of Police, Kurnool. 3.

Sri K.V.Raghuveer, learned counsel for the petitioner, informed this Court that after the filing of the counter affidavit, final report was filed before the competent criminal court. 4.

In that view of the matter, it is for the petitioner to take recourse to appropriate remedies in accordance with law, if he is aggrieved by the conclusion arrived at by the police authorities. Reserving the liberty to the petitioner to do so, the Writ Petition is closed. Pending miscellaneous petitions, if any, shall also stand closed in the light of this final order. No order as to

costs.
