This writ petition is being disposed of at the admission stage with the consent of both parties.
This writ petition is filed seeking a writ of Mandamus declaring the action of the respondents in rejecting the appointment of the petitioner to the post of Junior Panchayat Secretary in Kamareddy District and not treating the petitioner as local to Medak District for selection to the post of Junior Panchayat Secretary under recruitment notification dated 31.08.2018 contrary to G.O.Ms.No.124 dated 30.08.2018 as illegal, without jurisdiction and violative of Articles 14, 16 and 21 of the Constitution of India and sought a consequential direction to the respondents to select and appoint the petitioner to the post of Junior Panchayat Secretary against BCA (Women) local vacancy in Medak District under notification dated 31.08.2018 as per her merit and eligibility with all consequential benefits. Heard Sri S.
Rahul Reddy, learned counsel for the petitioner, and the learned Government Pleader appearing for the respondents. It has been contended by the petitioner that she is fully eligible and qualified to be appointed as Junior Panchayat Secretary and she has responded to the notification dated 31.08.2018 for appointment to the post of Junior Panchayat Secretary. The petitioner has further contended that she is a local to "Medak District" as she has studied all through her academic career in Medak District. The petitioner also contended that she is married and presently she is a permanent resident of Kamareddy. In the application form, the petitioner has claimed as native of Kamareddy District.
WP.No.8942_2019 AKS,J in the selections, but the respondents, at the time of verifying the certificates, have not considered her case to the post of Junior Panchayat Secretary in Kamareddy District on the ground that she is not a local candidate of Kamareddy District.
Learned counsel for the petitioner contends that if the respondents cannot consider the case of the petitioner as local candidate of Kamareddy District, the case of the petitioner can be considered in respect of Medak District by duly verifying the educational certificates of the petitioner. Learned counsel further submitted that the petitioner has submitted a representation to the respondents on 15.04.2019, but the respondents have neither passed any orders on the said representation nor considering the case of the petitioner for appointment to the post of Junior Panchayat Secretary. Therefore, learned counsel contends that appropriate orders be passed in the writ petition directing the respondents to consider the representation submitted by the petitioner and also to consider the case of the petitioner for appointment as Junior Panchayat Secretary in Medak District, treating her as a local candidate of Medak District after verifying the certificates.
Learned Government Pleader appearing for the respondents had contended that the case of the petitioner would be examined and appropriate orders would be passed on the representation submitted by the petitioner, in accordance with the Rules. This Court, having considered the rival submissions made by the parties, is of the considered view that this writ petition can be disposed of directing the respondents to consider the representation submitted by the petitioner on 15.04.2019 and pass appropriate orders within a period of four weeks from the date of receipt of a copy of this order.
